Schlecht, Shevlin & Shoenberger provides wage & hour advice to clients in Riverside and San Bernardino Counties and statewide.
The California Labor Code (Code) sets forth the rules regarding minimum wage, overtime pay and vacation pay. The California Division of Labor Standards Enforcement (DLSE) adjudicates and enforces the state’s labor laws. The wage & hour lawyers at Schlecht, Shevlin & Shoenberger assist clients in Riverside and San Bernardino Counties and statewide with current wage & hour advice.
Minimum Wage in California
The current minimum wage in California is $8.00 per hour and applies to most employees except:
- Outside sales people
- Parents, spouses, or children of the employer
- Apprentices
- Learners (those who have no experience in a field)
- Physically or mentally disabled employees if under special license from the DLSE
If the federal minimum wage is higher than California’s, the employer must pay the higher rate.
Overtime Wages—the law in California
You are entitled to overtime pay if any of the following occur:
- You work over eight hours in one workday
- You work over 40 hours in one workweek
- You work the first eight hours on the seventh day of work in any one workweek
Overtime pay for the above-listed situations is one and one-half times the regular rate of pay. However, if you work over 12 hours in one day or over eight hours on the seventh day of a workweek, you are entitled to twice the regular rate of pay.
Code Section 510 lists exceptions to the overtime pay rules that apply primarily to those working alternative workweek schedules. Schlecht, Shevlin & Shoenberger, a law corporation, can advise you whether the exceptions apply to you.
If your employer in California is not paying you minimum or overtime wages, you have two options:
- File a wage claim with DLSE
- File a lawsuit against your employer
