About Conservatorships in California

Conservatorships are legal relationships that grant one adult the right and obligation to care for another. In California, a conservatorship can either be general or limited. General conservatorships assign responsibility for full caretaking and financial management for individuals who are unable to manage these tasks on their own. Thus, general conservatorships are most common with elderly relatives suffering from deteriorating physical and mental faculties. Limited conservatorships are typically used to ensure continued provision of needed assistance to adults with developmental disabilities.

Like guardianships, California law recognizes separate conservatorships for basic care and protection (conservatorship of the person) and financial management (conservatorship of the estate). A conservator of the person is generally responsible for:

  • Meals, housekeeping and personal care,
  • Recreation,
  • Shelter and transportation, and
  • Health and general well-being.

By contrast, a conservator of the estate is charged with ensuring timely payment of the conservatee’s bills, receipt of the conservatee’s income, and general investment and management of the conservatee’s assets and budget.
